What the Vaping Lawsuits Are About
E-cigarettes — especially JUUL-brand devices — became enormously popular in the mid-2010s, particularly among teenagers. Plaintiffs in the litigation allege that JUUL Labs and related companies designed and marketed products with nicotine levels far higher than traditional cigarettes, and that they deliberately targeted minors through social media campaigns, flavored products, and youth-friendly packaging.
JUUL Labs has historically denied these allegations. The company has disputed claims that its marketing targeted minors and has challenged the causation theories advanced by plaintiffs.
By 2019 and 2020, the situation had drawn national attention when the CDC investigated a nationwide outbreak of serious lung injuries linked to vaping. The CDC attributed most of those cases to Vitamin E acetate found in THC-containing products, but also noted cases involving nicotine-only vaping products. The CDC named this condition EVALI — e-cigarette or vaping product use-associated lung injury.
In June 2022, the FDA issued a marketing denial order against JUUL, barring it from selling its products in the United States. That order was subsequently stayed, and the FDA's review of JUUL's products remains ongoing as of this writing.
The federal cases were consolidated into a multidistrict litigation: MDL 2913, in the Northern District of California. As of June 2025, approximately 4,700 cases in that MDL had been resolved, according to MDL court records and Bloomberg Law reporting.
What Injuries Are Being Claimed
