What This Lawsuit Is About

Kratom is a plant-based substance sold in powder, capsule, drink, and gummy form at gas stations, vape shops, smoke shops, and online retailers across the country. Companies have marketed it as a natural supplement — a safe way to ease pain, boost energy, or manage stress.

That marketing never came with a real warning. What companies did not prominently tell buyers: kratom contains active compounds that act like opioids in the body. And a concentrated, chemically enhanced form called 7-hydroxymitragynine (often labeled “7-OH”) — found in brands like MIT 45, Feel Free, 7OHMZ, Press’d, Jubi, and Ultra Seven — can be up to 30 times more potent than morphine, according to FDA warning letters issued July 15, 2025.

On July 15, 2025, the FDA sent formal warning letters to seven companies for illegally marketing 7-OH products, stating that these products cannot lawfully be sold as dietary supplements or conventional foods. The agency had already received thousands of reports of serious harm. (FDA Warning Letters, July 15, 2025.)

The CDC linked kratom to 152 deaths between 2016 and 2017. In most of those cases, kratom was detected alongside other substances — but in others, it was the primary or only substance found. (CDC MMWR, November 2019.)

About 1.7 million Americans use kratom regularly, many of them unaware that certain products on the market operate more like synthetic opioids than like herbal supplements. (FDA, 2024.)

Lawsuits against kratom manufacturers and distributors argue that these companies knew — or should have known — about the serious health risks but sold their products anyway without adequate warnings. Brands named in injury and death cases include OPMS, MIT 45, Hush Kratom, Feel Free, Kratom Divine, Whole Herbs, Remarkable Herbs, KRATOMade, and Dr. Kratom, among others.

What Injuries May Qualify

What About the Filing Deadline?

Every state sets a time limit for filing a personal injury or wrongful death case. In most states, that window is two to four years from the date of injury or the date you learned the injury was caused by the product. Some states are shorter.
